NOTIFICATION REGARDING THE PROCESSING OF PERSONAL DATA

Calipso S.R.L., with its registered office in Afumati, Sos. Petrachioaia 166/7, Ilfov County, Romania (“The Operator” or “Calipso”), informs you that, in the context of using the website, managing communications and/or managing requests sent/received by e-mail and/or telephone (as detailed in this document), it may process:

(i) personal data of representatives, contact persons, employees and/or collaborators of clients/potential clients, legal persons;

(ii) personal data obtained when you voluntarily submit your CV and/or a cover letter to fill a vacant position;

(iii) personal data deriving from requests and/or complaints and/or any other communications transmitted by telephone and/or via the e-mail address of the Operator.

The processing of personal data belonging to the data subjects mentioned in points (i) to (iii) for the purposes detailed in Section II of this document will be carried out by Calipso in accordance with the applicable local legislation and with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 9 5/46/EC (“General Data Protection Regulation”or“GDPR”), as well as with any other regulations applicable at European or local level adopted or that may be adopted in the context of the GDPR:

I. How do we collect your personal data?

Calipso collects and processes your personal data included in any written electronic correspondence (through the e-mail addresses of the Company), as well as through telephone calls, even if the respective electronic correspondence and/or telephone conversation has any of the aspects mentioned in points (i) to (iii) above and/or any other matters that could be the subject of e-mail communications and/or phone calls.

II. The purpose of the processing. The categories of personal data processed. The legal basis of the processing

As part of your interactions with Calipso, you may be the data subject with regard to your personal data that we process. Minors under the age of 18 may not transfer personal data to Calypso without the consent of their parents or legal representative.
As part of our day-to-day activities, we may process your personal data as follows:

1. Representatives, contact persons, employees and/or collaborators of clients/potential clients, legal persons

1.1. Processing purposes

The company may process your personal data detailed in point 1.2. below for the purpose of:

(i) taking the necessary steps to conclude a contract and/or to carry out and/or perform the contract concluded between Calipso and the entity you represent; and/or

(ii) to communicate in connection with any request and/or any aspect related to the contract concluded with the entity you represent (including any complaints and/or requests and/or communications made in the context of the performance of the contract) and/or in respect of which steps are taken to be concluded.

1.2. Categories of personal data processed

For the purposes mentioned above, the Company may process the following categories of personal data:

(i) name and surname; and/or

(ii) e-mail address; and/or

(iii) any other personal data that may be contained in the transmitted electronic communication (e.g. telephone number).

Although you do not have the legal obligation to provide personal data, the provision and processing of personal data may be necessary in the context of achieving the legitimate interests pursued by the Company regarding:

(i) taking the necessary steps to conclude a contract and/or to carry out and/or perform and/or perform a contract between Calipso and the entity you represent; and/or

(ii) any request and/or any aspect related to the contract with the entity you represent (including any complaints and/or requests and/or communications made in the context of the performance of the contract) and/or in respect of which steps are taken to be concluded.

1.3. Legal basis for the processing

Calipso processes the personal data referred to in point 1.2. above on the basis of Art. 6 (1) lit. f) of the GDPR, respectively for the purpose of achieving the legitimate interests pursued by the controller with regard to (i) initiating the necessary steps for the conclusion of a contract and/or the performance and/or performance of a contract concluded between Calipso and the entity you represent and/or (ii) any request and/or any aspect related to the contract concluded with the entity you represent (including any complaints and/or requests and/ or communications made in the context of the performance of the contract) and/or in respect of which steps are being taken to conclude it.

2. Persons applying for a vacant position in Calipso

2.1. Processing purposes

The Company may process your personal data detailed in point 2.2. below, in order to analyze your CV and/or cover letter, by reference to the position/position for which you are applying for employment.

2.2. Categories of personal data processed

For the purposes mentioned above, the Company may process the following categories of personal data:

(i) identification data: name, surname, place and date of birth, nationality; and/or

(ii) contact details: telephone number, e-mail address, fax, domicile/residence address; and/or

(iii) image; and/or

(iv) professional experience, studies, diplomas; and/or

(v) any other personal data that you voluntarily and unsolicitedly provide when transmitting your CV and/or letter of intent.

The provision of your personal data may be necessary in the context of the conclusion and/or execution of the individual employment/collaboration contract with Calipso.
Although you do not have the legal obligation to provide us with your personal data from your CV and / or from the cover letter, if you do not provide us with this data, we will not be able to initiate the relevant selection procedures to determine to what extent we can be part of our team or not and / or for the conclusion of the individual employment / collaboration contract with Calipso.

2.3. Legal basis for the processing

Calypso processes the personal data referred to in point 2.2. above on the basis of Art. 6 (1) lit.b of the GDPR, respectively for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract.

3. Persons who submit requests and /or complaints and/or any communications, by phone or to the e-mail address of the Operator

3.1. Processing purposes

The company may process your personal data detailed in point 3.2. below for the purpose of:

(i) managing and/or resolving requests and/or communications of any kind that you submit via your e-mail address or telephone, as well as to be able to provide answers to such requests and/or communications;

(ii) to handle and/or resolve complaints that you submit by e-mail or telephone, as well as to be able to provide answers to such complaints.

The provision of your personal data for the purpose set out in point (i) is not a legal obligation, but it may be necessary for the Company to be able to manage and/or solve requests and/or communications of any kind that you submit via e-mail or telephone address, as well as to be able to provide answers to these requests and/or communications.

With regard to the provision of your personal data for the purpose set out in point (ii) above, we mention that they are necessary for us to be able to manage and/or resolve your complaints, as well as to be able to provide answers to these complaints, in order to fulfill the legal obligations of Calipso, as referred to in article 3.3 (ii).

3.2. Categories of personal data processed

For the purposes mentioned above, the Company may process the following categories of personal data:

(i) identification data: name and surname, age; and/or

(ii) contact details: e-mail address, postal address, telephone number; and/or

(iii) any other personal data that you may voluntarily and unsolicitedly communicate to us, as contained in the e-mail / electronic communication transmitted or that you may send us by phone (for example, health data, if your complaint concerns such an aspect, the place of purchase of the product).

3.3. Legal basis for the processing

Calipso processes the personal data referred to in point 3.2. above:

(i) for the purposes set out in point 3.1. (i), based on art. 6 (1) lit. f of the GDPR, respectively for the purpose of achieving the legitimate interests pursued by the controller in analyzing and / or solving any request and / or any kind of communication transmitted by you in connection with calipso’s activity and / or products;

(ii) for the purposes set out in point 3.1. (ii), based on art. 6 (1) lit.c) of the GDPR, respectively for the fulfillment of the legal obligations incumbent on the Company deriving from the legislation on consumer protection, respectively:

(a) the provisions of Emergency Ordinance No. AN ANN.D. 34/2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing certain normative acts that provide for Calipso’s obligation to inform the consumer about the “policy of the professional to solve complaints“;

(b) the provisions of the General Procedure on the Settlement of Consumer Petitions of the Authority for Consumer Protection, which provide that:“when registering a complaint, it shall be verified whether the petitioner has previously presented himself to the seller, respectively whether he has delayed or refused to settle the complaint, in accordance with the law”;

(c) the provisions of the IFS Food standard which provide that:

  • “there must be a system for handling product complaints”;
  • “all complaints are evaluated by the competent staff. Where justified, appropriate measures shall be taken if necessary.”

III. Transmission of your personal data

We may transmit your personal data to: (i) Calipso employees and contractors, who will have access to your personal data exclusively for the purpose of resolving your request and/or complaint and/or communication and/or application and, if applicable, to (ii) the competent public authorities and/or institutions, within the limits of the powers conferred on them by the applicable legal provisions.

We will not transfer your Personal Data or your special data outside the EU/EEA.

IV. Updating and deleting data

Calipso wishes to keep your personal data accurate and up-to-date. Therefore, we kindly ask you to inform Calypso of any changes to the relevant personal data. In this regard, you can send an email to the address office@calipso.ro.

Calipso processes personal data in compliance with the principles of the GDPR, including the principle of data minimation and storage limitations.

In this regard, we will process personal data that:

(i) are appropriate, relevant and limited to the purpose for which they are processed; in this regard, Calipso will process only those data provided by you that are necessary for the fulfillment of the purpose for which they are processed;

(ii) are kept for a period not exceeding the period necessary to fulfil the purposes for which the data are processed; from this perspective, Calipso will delete, in accordance with the internal policies of the Company, all personal data that are no longer necessary for the purposes detailed above.

V. Your rights as a data subject

According to the applicable legislation on the processing of personal data, you have the following rights with regard to the processing of your Personal Data:

(i) the right to access your Personal Data;

(ii) the right to request the rectification of your Personal Data;

(iii) the right to request the deletion of your Personal Data;

(iv) the right to request the restriction of the processing of your Personal Data;

(v) the right to portability of your Personal Data;

(vi) the right to object to the processing of your Personal Data;

(vii) the right to withdraw consent at any time, without affecting the lawfulness of the processing carried out on the basis of the consent before its withdrawal: as well as

(viii) the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing.

VI. Existence of automated decision-making and profiling

Please note that your Personal Data will not be subject to automated decision-making, including profiling.
